Marchés publics et efficacité énergétique au Maroc
Entre ambition normative et effectivité opérationnelle

le cadre normatif marocain affiche une ambition remarquable. L'efficacité énergétique est intégrée à la commande publique à tous les niveaux constitutionnel, stratégique, législatif, réglementaire. Le décret sur les marchés publics de 2023 en fournit le socle procédural. Mais, dans la pratique des acheteurs publics, elle disparaît. Cet article suit cette disparition tout au long de la procédure de passation des marchés publics. En croisant l'analyse séquentielle de 46 dossiers d'appel d'offres et une enquête par questionnaire auprès de 30 acteurs de la commande publique, il montre où et comment l'exigence énergétique se dissout. Elle est présente à la définition des besoins, toutefois elle s'efface à l'admission, puis à l'attribution. L’explication n’est pas liée à une insuffisance juridique. Les textes existent et sont cohérents. Le blocage réside au niveau méso où les ambitions juridiques devraient se traduire en instruments opérationnels. Les acheteurs publics ne disposent pas, néanmoins, de référentiels techniques opposables. A défaut de ces outils, l'acheteur public privilégie le prix le plus proche du prix de référence, non par négligence, mais pour se protéger du contrôle. L'article propose, dès lors, une architecture de réforme sur trois niveaux : renforcer progressivement la contrainte réglementaire au niveau macro, standardiser les référentiels, surtout au niveau de l'évaluation (niveau méso), sécuriser juridiquement l'acheteur au niveau micro. Faute de cet alignement, l'intégration de l'efficacité énergétique reste formelle.
